Terms and Services Agreement
AGREEMENT BETWEEN USER AND CREAKYBONE.COM
The creakybone.com website (the "Site") consists of various web pages operated by CVCC LLC ("Creakybone"). Creakybone.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of Creakybone.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference. Creakybone.com is an E-Commerce Site. Electronic communications, visiting Creakybone.com or sending emails to creakybone.com or CVCC LLC constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.
ACCOUNT
You must be 21 years of age to purchase, or use the products on the Site. If you are under the age of 21 please exit the site immediately. It is your responsibility to know if products are legal to purchase at your location. If you create a Creakybone account, you are responsible for maintaining the confidentiality of your account and password. You further acknowledge and agree that you must be of legal age to purchase or consume any of Creakybone’s products or to participate in any of our promotions or other offers on the Site or otherwise. Creakybone reserves the right to use third-party age verification services at its discretion.
SHIPPING
Shipping charges are calculated at the time of order placement. Shipping outside of the United States is not available at this time. Prices will vary depending on geographical location and products purchased. Shipping service will be selected at the discretion of Creakybone.
PROCESSING
All orders shall be processed within 2 business days. Back-ordered items will be filled and shipped immediately upon inventory availability. All items purchased from us are shipped pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon delivery to the carrier.
INCOMPLETE ORDERS
If you are missing an item in your shipment, a claim must be presented within 7 days of the shipment being "Delivered" in the shipment tracking information.
CANCELATION AND RETURN POLICY
All sales are considered final. Products damaged in transit must be reported within 48 hours of delivery receipt. Damaged products may be returned for a replacement of an identical item only. Items out of stock will be shipped upon replenishment of stock. Acceptance of any and all returns of damaged products are at the sole discretion of Creakybone.
PAYMENT
All fees and taxes must be paid by the purchaser to Creakbone at the time of purchase. Any additional taxes levied by state or local governments not collected by Creakybone.com are the sole responsibility of the purchaser.
LIABILITY WAIVER
To the maximum extent permitted by applicable law, in no event shall CVCC LLC, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
To the maximum extent permitted by applicable law, CVCC LLC assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree to indemnify, defend and hold harmless Creakybone and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
HEALTH INFORMATION
Any statements on this site or material or products we sell or distribute have not been evaluated by the Food and Drug Administration. None of the products or ingredients in any of the products available on the site have been approved or endorsed by Food and Drug Administration or any other regulatory agency. No products on this site are designed to diagnose, cure, treat or prevent any disease. All statements on the site are for educational purposes only and should not be a substitute for medical advice. If you are pregnant or have any preexisting condition please contact your physician prior to use of any product or products.
RIGHT TO SUSPEND OR CANCEL USER ACCOUNT
We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment. We reserve the right to refuse service at any time at our sole discretion.
